U.S. Immigration and Customs Enforcement (ICE) officers in Buffalo have detained a British national who entered the United States without disclosing his criminal history in the United Kingdom. The individual, Orlando Duncan Da Silva Bain, was apprehended during a targeted enforcement operation on May 7 in Niagara Falls, New York.
Da Silva Bain, aged 19, had recently entered the U.S. as a nonimmigrant through Orlando, Florida. He violated the terms of his admission under the visa waiver program by failing to reveal his significant criminal record on his Electronic System for Travel Authorization application. As a result, he is subject to removal from the country.
Authorities later discovered that Da Silva Bain had been convicted of several offenses in the U.K., including taking a child to keep them from lawful control, engaging in penetrative sexual activity with a minor while being over 18 years old, inciting sexual exploitation of children aged 13-17, possessing indecent photographs or pseudo-photographs of children, causing minors aged 13 to 15 to view images of sexual activity by an offender over 18 years old, and sending obscene or indecent articles via postal service.
Currently held at the Buffalo Federal Detention Facility, Da Silva Bain awaits removal proceedings from the United States.
